Terms of Use
Draft: this page is waiting on review by a lawyer before TapHaul launches. It describes how the app works today.
Agreement
These terms are an agreement between you and TapHaul LLC and cover taphaul.com, the TapHaul app on the web, iPhone and Android, and the waitlist. By creating an account or using TapHaul you agree to them, to the Refund Policy (taphaul.com/refunds), and to how we handle data as described in the Privacy Policy (taphaul.com/privacy). Providers also agree to the Supplier Agreement, and drivers and workers to the Driver Terms.
What TapHaul is
TapHaul is a marketplace. Materials, deliveries and services are provided by independent businesses and people ("providers"), not by TapHaul. Providers are responsible for what they sell and do. TapHaul reviews providers, shows prices, takes payment, tracks deliveries and holds payment until delivery is confirmed.
Who can use TapHaul
You must be 18 or older and able to make a binding contract to create an account, join the waitlist or apply as a business. Give accurate information and keep it up to date. You choose "hiring" or "pro" when you sign up; it can't be changed later. Keep your sign-in safe; you are responsible for activity on your account. While TapHaul is invite-only, only invited people can sign in. We may suspend accounts that break these terms or put people at risk.
Prices, fees and taxes
Before you pay you see the delivered price, itemized: materials, delivery (based on road distance and the number of truckloads), the TapHaul service fee, sales tax on taxable items, and any tip you add. The service fee is a sliding scale on materials, add-ons and delivery (8% on the first $500, 6.5% up to $1,500, 4% up to $3,000 and 3% above that), or a flat 2% for businesses on a contractor plan, shown as its own line before you pay. Where we add a credit card surcharge (up to 3%, never on debit cards or bank payments), it is also shown as its own line before you pay, and you can pick a payment method without it. You are charged the total shown when you place the order; there are no other charges unless you agree to a change. Providers pay TapHaul a separate fee out of what they are paid; it is never added to your price.
Payment protection
- You pay in full when you place an order. TapHaul holds the money; the provider is not paid yet.
- The driver photographs the drop. You confirm the delivery in the app, or, if you don't, it confirms itself 24 hours after the photographed drop. When every load on the order is done, the provider is paid.
- Loads that are not delivered are refunded. If nothing is delivered, you get everything back.
- If something is wrong with a delivery, use Report a problem on the order, ideally before it confirms. We review every report and can refund all or part of an order, including after the provider has been paid.
- If you dispute a charge with your bank, the payment stays held until the bank decides.
Details are in the Refund Policy at taphaul.com/refunds.
Cancelling
You can cancel in the app for a full refund until a truck leaves the yard. After that, contact support; the provider may already have costs. Refunds go back to your original payment method; banks usually take 5 to 10 business days to show them.
Deliveries and your site
Put the drop pin on the exact spot and give accurate notes and access. You are responsible for having the right to receive the delivery there and for the site being suitable for a loaded truck (ground strength, overhead lines, underground utilities, septic systems, slopes and permits). Drivers may refuse an unsafe drop. Weights on scale tickets are the provider's.
Tappy
Tappy is an AI assistant. Its answers can be wrong or out of date, so check prices, quantities and details on the app's own screens. Tappy can only propose an order or a change; nothing happens until you tap Yes, and you are responsible for what you confirm.
Community
Be respectful, post only what you have the right to share, and never post a street address, gate code or someone else's personal details. You can report or block other members. We may remove posts and suspend accounts that break these rules.
Acceptable use
You agree not to:
- break the law or the rights of others, or harass anyone;
- arrange to pay providers outside TapHaul for work found through TapHaul;
- post false reviews, or misuse others' information, including gate codes and locations;
- use bots, scrape, overload, probe or bypass the security of TapHaul.
Your content
You keep ownership of photos and content you upload. You give TapHaul permission to store and show it as needed to run your orders, resolve disputes and, for community posts, show them to other members.
Our content
The TapHaul name, logo, app and site design belong to TapHaul or its licensors.
Closing your account
You can delete your account at any time in the app (Account, Delete account). We may suspend or close an account that breaks these terms, and we tell you why unless the law or safety stops us.
Disclaimers
TapHaul is provided "as is" to the extent the law allows. We don't guarantee that a provider will be available or that arrival times will be exact; estimates depend on traffic and the yard.
Limit of liability
To the extent the law allows, TapHaul is not liable for indirect, incidental, special or consequential damages, and our total liability for a claim is limited to the greater of $100 and the fees TapHaul received for the order involved. Nothing here limits liability that can't be limited by law.
Problems with TapHaul
If you have a complaint about TapHaul itself, email support@taphaul.com first and we will try to sort it out within 30 days.
Law and changes
These terms are governed by the laws of the State of Wyoming, except where your local consumer law says otherwise. We may update these terms by posting a new version and telling account holders about material changes. Questions: support@taphaul.com.
